1. Introduction

Welcome to Wild Tiger Buggy ('Company', 'we', 'our', 'us')! These Terms of Service ('Terms', 'Terms of Service') govern your use of our website located at https://www.wildtigerbuggy.com (together or individually 'Service') operated by Wild Tiger Buggy.

Our Privacy Policy and Cookies Policy also govern your use of our Service and explain how we collect, safeguard, and disclose information resulting from your use of our web pages.

Your agreement with us includes these Terms, our Privacy Policy, and our Cookies Policy ('Agreements'). You acknowledge that you have read and understood the Agreements, and agree to be bound by them. If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing reservations@wildtigerbuggy.com so we can try to find a solution. These Terms apply to all visitors, users, and others who wish to access or use the Service.

2. Communications

By creating an account or booking an excursion on our Service, you agree to receive essential operational communications (booking confirmations, pickup vouchers, driver schedule notices). You may also opt in to receive newsletters, marketing, or promotional materials. You may opt out of promotional messages at any time by following the unsubscribe link or by contacting us at reservations@wildtigerbuggy.com.

3. Purchases, Payments & Guest Representation

If you wish to purchase any product or service made available through Service ('Purchase'), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit or debit card number, card expiration date, billing address, and WhatsApp contact number for pickup logistics.

You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct, and complete.

We employ third-party payment services (such as PayPal, Inc., conforming to Level 1 PCI-DSS standards) for facilitating payment and completing Purchases. By submitting your payment information, you grant us the right to transmit that information securely to these authorized third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: vehicle availability, capacity constraints, errors in the description or pricing of the excursion, or suspected fraud or unauthorized transactions.

4. Contests, Sweepstakes, and Promotions

Any contests, sweepstakes, or coupon promotions (collectively, 'Promotions') made available through Service may be governed by rules separate from these Terms. If the rules for a Promotion conflict with these Terms of Service, the specific Promotion rules will govern.

5. Refunds & Cancellation Policy

• 100% Full Refund (24h Prior): Applies when cancellation is submitted at least 24 hours in advance of the scheduled excursion shift.
• Less Than 24 Hours / No-Show: All cancellations made less than 24 hours prior to the start time of the service, or customer no-shows at the designated resort lobby pickup point, will be charged in full. An exception applies only when supported by a legitimate medical note from a qualified licensed physician stating the valid medical condition preventing participation.
• Complimentary Shuttle & Personal Transport: Roundtrip hotel transportation is provided strictly as a complimentary courtesy service free of charge for our guests and is not an itemized component of the excursion price. Consequently, guests choosing to travel to our base camp via their own vehicle, rental car, or private taxi are not entitled to any transport refunds, price reductions, or cash discounts.
• Weather Cancellations: Excursions run rain or shine (mud is part of the off-road buggy fun!). In the rare event of extreme, hazardous weather (e.g. tropical storm or civil alert issued by Dominican authorities), Wild Tiger Buggy will reschedule your excursion free of charge or issue a 100% refund if rescheduling is impossible during your stay.

7. User Content & Intellectual Property

Our Service allows you to submit reviews, photos, videos, or feedback ('Content'). You represent and warrant that you own or possess necessary rights to any Content you share, and that it does not infringe upon any third party's privacy or copyright.

By posting Content, you grant Wild Tiger Buggy a non-exclusive, worldwide, royalty-free license to use, display, and reproduce such material for promotional, marketing, and customer testimonial purposes.

8. Prohibited Uses & System Integrity

You agree not to use the Service: (i) in any way that violates national or international law; (ii) to harass, abuse, or impersonate others; (iii) to introduce malicious code, denial-of-service vectors, or automated scrapers; or (iv) to manipulate pricing, discount codes, or circumvent mandatory policy consent.

9. Age Eligibility & Accounts

The Service is intended solely for access by individuals at least eighteen (18) years of age. By creating an account or placing a reservation, you warrant that you are at least 18 years old with full capacity to enter into binding agreements.

You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You agree to notify us immediately of any unauthorized access.

10. Copyright Policy & DMCA Notice

We respect intellectual property rights. If you believe your copyrighted work has been copied in a manner constituting infringement, please email our designated agent at reservations@wildtigerbuggy.com with the subject line 'Copyright Infringement / DMCA Notice' including full identification of the work and authorization.

11. Disclaimer of Warranty & Limitation of Liability

THE SERVICES AND ALL INFORMATION, CONTENT, AND EXPERIENCES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE.' TO THE MAXIMUM EXTENT PERMISSIBLE BY APPLICABLE LAW, WILD TIGER BUGGY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

IN NO EVENT SHALL WILD TIGER BUGGY, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR PARTICIPATION IN OFF-ROAD ACTIVITIES OR WEBSITE USAGE. OUR TOTAL AGGREGATE LIABILITY SHALL BE STRICTLY LIMITED TO THE AMOUNT PAID BY YOU FOR THE PRODUCT OR EXCURSION RESERVATION.

12. Governing Law & Jurisdiction

These Terms and any dispute arising out of or related to our Services shall be governed and construed in accordance with the laws of the Dominican Republic, without regard to its conflict of law principles.

13. Amendments & Versioning

We may revise these Terms from time to time to reflect regulatory, logistical, or platform updates. Every version is assigned an immutable version code (currently v2026.1). Continued use of the website or booking services following revisions constitutes full acceptance of the updated terms.
